Typically, hotels and resorts have private beaches. All of these owners maintain that beach property in compliance with city ordinances. They are responsible for hiring their own lifeguards, if needed. The public is not allowed on these beaches unless they have permission by the owner.
Private Beach means any beach which is not a public beach as defined in the Act.

Basically the beach is like the side of the state highway, up to the high tide line, and no one “owns” it since it's covered in water twice a day. That's the law in most east coast states (except Maine, Massachusetts, Delaware and Virginia, where it's low tide line).

Sea Island is a private, gated island accessible only to Resort Guests and Sea Island Club members. NOBODY OWNS THE BEACH — EXCEPT THE CROWN
All of the beaches in Australia are technically Crown land, meaning they're for public use. As a general rule of thumb, any land that high tide touches — known as the high water mark — is Crown Land.
ABORIGINAL LAND CLAIMS
Under the Aboriginal Land Rights Act 1983 (NSW), vacant Crown land can be granted as freehold to Aboriginal people if it is not lawfully used or occupied, required for an essential purpose or for residential land, or impacted by a registered application or determination of native title.
You will need to hold a Crown lease or licence if you intend to use or occupy Crown Land or reserved land. A lease can be granted for any purpose that the agency sees fit.
