The fixed rate for child support periods starting on or after 1 January 2023 is $1,632 per child per year. If you pay the fixed rate for more than 3 children, we'll cap the amount at 3 times the fixed rate. If you pay the fixed rate to more than one person, we divide the amount between those receiving parents.

The single best thing for avoiding child support is to spend time with your children. How much you pay basically depends on how many nights per fortnight the children spend with you. If you have the kids 7 nights per fortnight, you're assumed to be covering 50% of their costs through direct care.
Parents have a legal responsibility to provide financially for their children even if they no longer live with them. When child maintenance is paid it can make a significant difference to the lives of families.
2. It's unfair to hard-working parents. Australia's child support formula is generally unfair to parents who earn a good income. Every dollar that's given to one parent because they have a lower income is a dollar taken from the main financial contributor.
Child support scheme
Under Australian law, separated parents (including same sex parents) have a duty to provide a proper level of financial support for their children.
Technically, mothers' rights vs fathers' rights do not exist in Australia. The Family Law Amendment Act 2006 changed the emphasis from the parents to the children; the term 'shared parental responsibility' is now used instead.
Liability order from a court
CMS can take you to court over unpaid child maintenance. They can apply for a court order to take legal action. This is a 'liability order'. If the court grants the order, CMS can then legal action against you.
According to the Maintenance Act, non-compliance with a maintenance order is a criminal offence unless the reason for non-payment is due to a lack of means. The Act describes various ways to enforce maintenance orders when an ex-spouse is refusing to pay and to force them to pay the defaulted amount.
You will not be expected to pay anything through the Child Maintenance Service if you: Share care equally with the other parent. Are in full-time education with no income.
2. What is the maximum child support in Australia? You can calculate the maximum child support amount using the combined income of both parents, up to 2.5 times the annual equivalent of the Male Total Average Weekly Earnings, as well as the Costs of Children Table.
In Australia, parents are not imprisoned for failing to pay child support.
If you don't pay your child support in full and on time, we may apply penalties on the outstanding amount. You pay the penalty amount to the Australian Government, not to the receiving parent. If you pay the overdue child support, we may reduce or remove the penalty from your account.
In Australia shared custody means that the non-residential parent pays child support to the residential parent. In the case of a 50/50 split, the higher earner usually pays child support to the lower earner to ensure the children's standard of living is the same in both locations.
On the basic rate, if you're paying for: one child, you'll pay 12% of your gross weekly income. two children, you'll pay 16% of your gross weekly income. three or more children, you'll pay 19% of your gross weekly income.
Average Child Support Order. We have seen according to the 2010 Census Bureau Reports, the average monthly child support payment is $430. Again, this is just an average of the monthly amount of child support payments across the United States and should only be used as an estimate.
If a parent cannot afford to pay maintenance, the court will order him/her to pay a lesser amount. If a parent has no income at all, he/she will not be required to pay maintenance, unless he/she owns significant assets which can be used to pay maintenance.
In order to claim for maintenance, you must first determine the reasonable needs of the child on a monthly basis. There is no hard and fast rule, but generally the child's share of the common expenses in the household is determined by allocating one-part per child and two-parts per adult or older child.
[1] If a parent is unemployed and does not receive an income the Maintenance Court may order that assets be attached and sold to pay for the maintenance of the minor child. In the worst-case scenario failure to pay maintenance can also be deemed a criminal offence and may be susceptible to criminal prosecution.
If the other parent won't agree to repay the arrears
If that doesn't clear the arrears, the CMS can apply to court for a 'liability order'. This means they can ask bailiffs to take goods from the other parent and sell them. If the other parent owns their home, the CMS can also ask a court for an order to sell it.
Child maintenance payments usually stop when children reach the age of 16. However, if the child is in full-time approved education, it may stay in place until they reach the age of 20.
If they don't pay, the CMS can take enforcement action – for example, taking money from their wages or forcing the sale of a property or belongings. The paying parent will also have to pay extra charges if, for example, money has to be taken from their wages.
Parenting time
These terms are no longer used in Australian family law. There is no rule that children must spend equal or "50:50" time with each parent.
In 45 percent of cases, the mother is given sole custody of the children. Only 11 percent of fathers will be granted sole custody. In 3 percent of court cases, courts order a no contact order against a parent. Only 3 percent of cases go to court.
A mother cannot deny a father access to their children in Australia. There is a presumption of equal and shared parental responsibility. Only an order from a local court or the Federal Circuit Court and Family Court of Australia would be able to stop a father from accessing their children in Australia.
