Sending sexually explicit images or video to a non consenting party, be it intentionally or unintentionally, can be classified as lewd behavior or sexual harassment.
Some risks of sexting include: Permanency: you can't “unsend” a sext. Blackmail: sexual messages could be used to manipulate you in the future. Emotional health: if someone shares your message without your consent, it could affect your mental and emotional well-being.
Some forms of sexting can be classed as online sexual harassment, particularly when the sharing is non-consensual or an image has been shared in retaliation or 'revenge'.
Even if you were involved in a conversation that was legally recorded, it's still illegal to communicate the conversation or publish it without the permission of the other people involved in the conversation (with some exceptions).
In Australia we know that 1 in 3 young people aged 14 – 17 years have had some experience with sexting.
It is punishable by up to 3 years' imprisonment and/or a fine of $11,000. And section 91R makes it a crime for anyone to threaten to record or distribute an intimate image without consent, intending the other person to fear the threat would be carried out.
Image-based abuse is illegal in Queensland. Image-based abuse includes: taking a nude or sexual image of someone without their permission. sharing or posting a nude or sexual image of someone online without their permission.
Sexting can cause serious problems for teens. Not only can it lead to social embarrassment, but it can also lead to bullying and cyberbullying. It can also affect a person's career choices and can lead to “Sextortion” which is the act of sharing naked pictures with another person to harm them.
