You need to account for all of your income on your tax return, not just your salary or wage. Fail to do so, and you could trigger an audit. Lying on your taxes – Claiming more deductions than you're entitled to or hiding income will be traced. That is illegal behaviour, and you can expect it to have consequences.
Some red flags for an audit are round numbers, missing income, excessive deductions or credits, unreported income and refundable tax credits. The best defense is proper documentation and receipts, tax experts say.
For FY 2021, the odds of audit had been 4.1 out of every 1,000 returns filed (0.41%). The taxpayer class with unbelievably high audit rates – five and a half times virtually everyone else – were low-income wage-earners taking the earned income tax credit.
As the Australian tax system is a self-assessment system, later reviews and audits have time limits in which the ATO can backtrack: For simple income tax assessments – 2 years from the date an assessment is issued. For more complex tax assessments – 4 years from the date an assessment is issued.
In Australia, getting something wrong on your tax return often means little more than a frustrating delay with your refund. However, around 2 million people a year aren't that lucky. Instead, they face an audit covering up to five years of their tax affairs.
Your Australian bank account statements are accessible to the ATO. The ATO is endowed with extensive legal authority, which allows it to access your personal bank information. Because of these capabilities, the ATO is able to get your Australian bank statements straight from your financial institution.
Don't worry about dealing with the IRS in person
Most of the time, when the IRS starts a mail audit, the IRS will ask you to explain or verify something simple on your return, such as: Income you didn't report that the IRS knows about (like leaving off Form 1099 income)
Who gets audited by the IRS the most? In terms of income levels, the IRS in recent years has audited taxpayers with incomes below $25,000 and above $500,000 at higher-than-average rates, according to government data.
The IRS receives a copy of the tax forms you receive, including Forms 1099, W-2, K-1, and others and compares those amounts with the amounts you include on your tax return. If they are not the same, there is a good chance you'll be audited.
Avoid uunnecessary technical jargon.
If you use more than one phrase such as “transactional controls,” “stratified sampling methodology,” or “asynchronous transfer mode” on a single page of an audit report, don't be surprised when some of your readers check out without reading to the end of the report.
You (or your tax pro) will meet with the IRS agent at an IRS office. The IRS usually starts these audits within a year after you file the return, and wraps them up within three to six months.
What happens if you get audited and owe money? If you get audited by the IRS and owe money, you'll be notified of the additional tax that you're required to pay as well as any penalties and interest due. The correspondence that you receive from the IRS will mention a deadline by which you must pay.
If your business income is lower than the benchmark range for your industry, you will have more chance of being targeted for an ATO audit. However, if it is lower and you have valid reasons why, then there should be nothing for you to worry about. You might need to focus on improving your business performance instead.
As you'd expect, the higher your income, the more likely you will get attention from the IRS as the IRS typically targets people making $500,000 or more at higher-than-average rates.
Checking to see if you have received your refund does not trigger an audit. But there are many other factors that can lead the IRS to take a closer look at your return – such as math errors, failure to report income, or too many deductions claimed.
If the IRS decides to audit, or “examine” a taxpayer's return, that taxpayer will receive written notification from the IRS. The IRS sends written notification to the taxpayer's or business's last known address of record. Alternatively, IRS correspondence may be sent to the taxpayer's tax preparer.
Our own tax experts at The Tax Institute state, “The IRS can conduct only one inspection of a taxpayer's books and records for any given year unless the taxpayer requests a second inspection or the IRS notifies the taxpayer in writing that an additional inspection is necessary.”
