China would never admit this economical interests openly towards the Syria situation, but they do have spoken of other reasons about why they will never be members of the ICC. China has concerns about the openness of the ICC to political influence since any prosecutor can make the decision to start an investigation.
China's position on the ICC
China was very active in the process of drafting the Rome Statute. It was therefore disappointing when China was one of only seven states that chose to vote against the adoption of the Rome Statute.
China believes that such a court would be a helpful supplement both to national judicial institutions and to the international criminal cooperation system. China also actively participated in the negotiations for the Rome Statute, and made significant contributions to it.
The ICC seeks to investigate and prosecute those responsible for grave offenses such as genocide and war crimes. Dozens of countries are not ICC members, including China, India, Russia, and the United States.
On 17 July 1998, the Rome Statute of the International Criminal Court was adopted by a vote of 120 to seven, with 21 countries abstaining. The seven countries that voted against the treaty were China, Iraq, Israel, Libya, Qatar, the U.S., and Yemen.
Australia provides consistent financial support to the court. As well as contributing to the annual budget Australia has provided voluntary funding to key initiatives. These include the Trust Fund for Victims, the Trust Fund for Least Developed Countries and the Internships and Visiting Professionals Program.
Incompatibility with the U.S. Constitution
United States participation in the ICC treaty regime would also be unconstitutional because it would allow the trial of U.S. citizens for crimes committed on U.S. soil, which are otherwise entirely within the judicial power of the United States.
In October 2016, Burundi and South Africa formally wrote to the United Nations Secretary-General to communicate their decision to withdraw from the ICC.

Jurisdiction and enforcement
The ICC does not have jurisdiction over crimes committed fully in Russia by Russian nationals, as Russia is not a party to the Rome Statute which created the ICC.
South Africa began proceedings to leave the ICC in 2016 after a dispute over whether to arrest the former Sudanese president, Omar al-Bashir, who visited for an African summit while under ICC indictment for genocide and crimes against humanity.
