Since 1 October 2021, all nicotine vaping products are prescription only medicines across all Australian States and Territories. It is illegal to import, buy or sell vape or e-liquid without a valid permit or prescription. Heavy penalties, including fines and imprisonments apply.
There are strict requirements as to how e-cigarettes and their products can be displayed as these devices are classified as 'tobacco products' and must only be marketed to an adult audience. Please note that you will require a separate approval to sell e-cigarettes.
It is an offence to sell, possess for sale, import or distribute such items. For each charge, those convicted can be fined up to $10,000 and jailed for up to six months.

A person who sells a vape to someone under 18 commits an offence. This is a strict liability offence; the owner of the business can be held responsible as well as the member of staff who made the sale. There is an exception for vapes that are licensed as medicines or medical devices.

Regulation of e-cigarette products
The sale of e-cigarette products containing nicotine is already illegal in Victoria under the Drugs, Poisons and Controlled Substances Act 1981.
The minimum age for buying any nicotine or tobacco-containing product is 18. This includes related products such as vape devices, coils, atomizers, vape juice, or heated tobacco products. It is also illegal for adults to buy – or be found attempting to buy – tobacco or vaping products for anyone under the age of 18.
