A former tax agent has been sentenced to 6 years imprisonment with a non-parole period of 3 years and 6 months for claiming more than $800,000 in fraudulent refunds.
The ATO shares information with a range of government partners when responding to fraud, including law enforcement agencies. If you engage in tax fraud, you will be caught, and the best case is that you will need to repay amounts fraudulently obtained in full. The worst case is that you will go to jail.
The ATO can, and will, check your bank accounts, cross reference payments against an ABN and confirm missing income from your tax return.

The reason for this is to do with what has been included or excluded in your tax return; for example, attempting to reduce taxes by not correctly including income or incorrectly overclaiming deductions can trigger an ATO Audit.

Usually, tax evasion cases on legal-source income start with an audit of the filed tax return. In the audit, the IRS finds errors that the taxpayer knowingly and willingly committed. The error amounts are usually large and occur for several years – showing a pattern of willful evasion.

You could face civil penalties.
Bigger understatements mean bigger consequences. In this case, the most common penalties are: Negligence penalty: 20% of the additional tax. Fraud penalty: 75% of the additional tax due to fraud.
The ATO has strong legal powers to access your personal bank information. Those powers allow the ATO to get your Australian bank statements directly from your bank. Therefore, any cash that you have deposited in your bank account may be subject to review and audit the ATO.
An ATO spokeswoman said phones were only accessed with a warrant under the Crimes Act, or with written consent from the owner. "For operational reasons, we do not disclose information about when different tools are used as part of our operations," she said.
Under current Federal legislation, all Australian banks are required to report cash transactions of $10,000 or more (or foreign equivalent), including details of the relevant account holders, to the regulator, the Australian Transaction Reports and Analysis Centre (AUSTRAC).
Audit Rate

If your business income is lower than the benchmark range for your industry, you will have more chance of being targeted for an ATO audit. However, if it is lower and you have valid reasons why, then there should be nothing for you to worry about. You might need to focus on improving your business performance instead.
The following behaviours and characteristics may attract our attention: tax or economic performance not comparable to similar businesses. low transparency of your tax affairs. large, one-off or unusual transactions, including the transfer or shifting of wealth.
Tax evasion is a felony, the most serious type of crime. The maximum prison sentence is five years; the maximum fine is $100,000. (Internal Revenue Code § 7201.) Filing a false return.
The ATO will provide written confirmation including their meeting agenda outlining key issues and a draft audit management plan. Most audits are escalated from the review process, but they might also proceed straight to an audit in cases of less complex issues or where they suspect fraud or evasion, or high risk.
If you are audited and found guilty of tax evasion or tax avoidance, you may face a fine of up to $100,000 and be guilty of a felony as provided under Section 7201 of the tax code. A simple mistake in a tax return won't be considered tax evasion.
