Family and Medical Leave Act
The Family & Medical Leave Act (FMLA), gives eligible workers up to 12 weeks of unpaid time off after the birth or placement of a child. FMLA applies to fathers and non-birthing parents in addition to mothers, and in 2015, the law was amended to include same-sex couples too.

Under the new entitlements, both parents can take up to 14 weeks paid parental leave.
What's changing. From 1 July 2023, partnered couples can claim up to 20 weeks' paid parental leave between them. Parents who are single at the time of their claim can access the full 20 weeks. The former Dad and Partner Pay entitlement has been removed.
Each parent can take up to 12 months unpaid parental leave, or up to 24 months, if their employer agrees. An employee's entitlement to unpaid parental leave is not affected by how much leave their partner takes. The parents can be working for the same or different employers.
From 1 July 2023, Parental Leave Pay and Dad and Partner Pay combined into one payment. Parental Leave Pay increased from 90 days (18 weeks) to 100 days (20 weeks). If your child's date of birth or adoption is on or after this date, you'll need to apply for Parental Leave Pay not Dad and Partner Pay.
Baby Bonus is an income tested payment and is payable to families whose estimated combined adjusted taxable income is $75,000 or less in the 6 months following the date the child first entered your primary care. To get Baby Bonus: you or your partner must be the primary carer of your child.
The most common arrangement is that the mother takes 66-84% custody of the child or children, while the father takes 14-34%.
Newborn Upfront Payment and Newborn Supplement
The Newborn Supplement is calculated based on your income and the number of children in your care. The most you can receive is $1725.36 for your first child and $576.03 for subsequent children (as of April 2022).
Dad and Partner Pay is currently $882.75 per week before tax. It's based on the weekly rate of the national minimum wage. Dad and Partner Pay must be paid as a single block of up to 2 weeks. We'll pay you in one instalment, directly into the bank account you choose.
In most cases your employer will deliver your Parental Leave Pay for a child born or adopted before 1 July 2023 to you. Sometimes, we'll pay you directly. Your Paid Parental Leave period for a child born or adopted before 1 July 2023 can be up to 12 weeks.
There are no set rules about how long to wait before taking a newborn out into the world or when to let people near the baby. Some doctors recommend that parents wait until their baby is a few months old before going to crowded public places (like malls, movie theaters, and airplanes).

While there's no set age, most parents don't feel comfortable leaving their baby until after the first four to nine months. Before that, a lot is going on with your baby as they learn their daily routine. You may still be perfecting breastfeeding or working on the bond between you or your partner and the baby.
How Much Is The Baby Bonus? If your child was born or adopted before 1 July 2013, the baby bonus is $5,000. If your child was born or adopted on or after 1 July 2013, or you became eligible for the baby bonus during this timeframe, the payment is either $5,000 or $3,000 depending on your situation.
On 1 March 2014, when the Baby Bonus Scheme is finally put to bed after more than 13 years and replaced changes to Family Tax Benefit Schedule A, it will have left a legacy in terms of the generation it created.
The amount of Baby Bonus currently payable is $5,000 per eligible child and it is made in 13 fortnightly instalments. The first instalment is paid at a higher rate of $846.20 and the other 12 fortnights are paid at a rate of $346.15. The Baby Bonus is paid at the same rate to all families considered eligible.
How much you can get. Parental Leave Pay for a child born or adopted from 1 July 2023 is based on the weekly rate of the national minimum wage. Your family can get up to 20 weeks, which is 100 payable days. The current payment for Parental Leave Pay is $176.55 a day before tax, or $882.75 per 5 day week.
If you have sole custody of the child, you are entitled to all 480 days. For 390 of these days, parental benefit is based on your income. For the remaining 90 days, the benefit is the minimum level. You are each entitled to 195 days at sickness benefit level, and 45 days each at the minimum level.
This can be either the child's mother or father, or another relative such as a grandparent. The primary caregiver is typically the person who is most involved in the day-to-day care of the child, and who provides the majority of financial support. In some cases, the primary carer may also be the child's legal guardian.

Income support payments
When your Parental Leave Pay ends, we'll adjust your and your partner's income support again. In some cases, your income will be too high to keep getting your income support payment. If your income support stops, you can apply for it again after your Parental Leave Pay ends.
The Federal Government's Paid Parental Leave Scheme provides up to 18 weeks of paid leave if you are having or adopting a child. If you are eligible for this payment, you will be paid the minimum wage while you are on the scheme, not your usual salary.
