Voldemort WOULD become an empty vessel as he has already locked 6 sevenths of his soul in horcrux's so what's left in Voldemort himself IS actually his only soul. If a dementor sucked this out then he would have no soul left in his actual body at the time.
The Dementor is simply unable to perform the kiss on a wizard who has a Horcrux. Voldemort is unaffected and has a good laugh at the silly Dementor.
It's not exactly clear what would have happened if a Dementor had succeeded in kissing Harry Potter, because Harry had a fragment of Voldemort's soul in his body in addition to his own. It is possible that the Dementor would have ingested both Harry's soul and also the fragment of Voldemort's soul.
