If your mark covers both goods and services, use TM. The federal registration symbol, ®, is only for marks registered with the USPTO.
The R Symbol ®
Usually, using ® means that your trademark is registered in a country. In some countries, however, its use is non-regulated and you can apply it even to unregistered trademarks (Canada is an example).
The symbol ® is a notice of registered trademark ownership. It is used to advise the public that a trademark or service mark is registered, providing notice of the legal ownership status of the mark with which it is used. The ® symbol should be used only in connection with registered trademarks or service marks.
You can use the ™ symbol on your brand material if you have not filed a trade mark application or you have a pending trade mark but it is not essential and it gives you no legal rights.
The ™ symbol is used with unregistered marks, when a business intends to claim a trade mark, or while its trade mark application is being processed by IP Australia. The ® symbol is used once your mark has been registered as a trade mark by IP Australia.
In the United States, the copyright notice consists of: "©" or the word "Copyright" or abbreviation "Copr."; the year of first publication of the copyrighted work; and.
Be sure not to confuse the registered trademark symbol with the copyright symbol. The latter looks very similar but uses a C instead of an R inside the circle. In some jurisdictions, a circled P (for "phonogram") is used specifically with copyrighted audio.
Summary of the general rules:
® means "Registered Trademark" (as validated by the Patent & Trademark Office). TM means "Trademark" (any mark filed with a Trademark Office). © means "Copyright". As should first be recalled, the © (copyright) is a reserved right notice concerning any work that can be copyrighted.
In the United States, it is proper to use the registration symbol ® only to give notice that a trademark has been federally registered in the United States Patent and Trademark Office. The proper form of registration notice is the letter "R" in a circle ® placed in immediate conjunction with the registered mark.
Using the trademark symbols TM, SM, and ®
The symbol lets consumers and competitors know you're claiming the trademark as yours. You can use “TM” for goods or “SM” for services even if you haven't filed an application to register your trademark. Once you register your trademark with us, use an ® with the trademark.
TM is used to claim the ownership of the brand name or logo or tag line. It can be used without applying for trademark registration. R indicates that it has been registered by the Trademark Registry. C is for copyright.
There is some flexibility in how you use any trademark symbol. Still, you typically put the registered trademark symbol (®) immediately next to the trademark and in the upper right corner for words and the lower right corner for logos.
Even though use of the symbol is optional, a registered trademark owner who fails to use it is barred from recovering profits and damages in a trademark infringement lawsuit unless the infringer had actual notice of the trademark registration (which may be quite difficult to prove in many cases).
You may also conduct a trademark search by visiting the USPTO's Public Search Facility or by visiting a Patent and Trademark Resource Center near you. These resources are free to the public. For additional assistance, you may wish to hire an experienced trademark attorney.
The R in a circle (®) means it's a registered trademark .
Although it is not a legal requirement, you can use the TM symbol to identify your unregistered trade marks. A trade mark is a form of intellectual property that can distinguish your goods and services from those offered by your competitors.
