If a renter doesn't pay the late rent after they've been given a notice to vacate by the due date, the rental provider can apply to VCAT for a possession order. A possession order is an order for the renter to leave so the rental provider can take back possession of the property that can be enforced by police.
Even when repairs are not completed, a tenant should never stop paying the rent. Withholding rent will put them in breach of their tenancy agreement and the tenancy may be terminated.
If you pay rent in cash
If you pay your rent in cash you must be given a written receipt. The receipt must state who you paid the rent money to, how much rent you have paid, and the dates the rent is for. Keep a copy of your rent receipts as they are evidence you have paid the rent.
If you are evicted
If you're still in the property by the date in the termination order, a sheriff's officer can legally remove you from the property under a warrant for possession issued by the NSW Civil and Administrative Tribunal or a court.
You and the landlord must both agree on the plan - about how much money and when to pay it. If you both agree you should write this down and both sign. Can I be asked to leave? If your rent is more than 14 days behind, the landlord can give you a Termination Notice to end your tenancy.
Not paying, or being behind in rent payments may mean the tenant is given a termination notice, which could make it harder for them to rent another property in the future.
Not paying rent, damaging the property or using the premises for illegal activities are things that would be considered grounds for eviction, and most likely fall under a breach of the tenancy agreement.
The landlord must give the tenant at least 14 days notice of termination. Examples of orders by the Tribunal include: pay the landlord compensation, fix a breach of the tenancy agreement, or refrain from behaviour that breaches the agreement.
There are no laws limiting the amount of cash you can keep at home. This makes sense as many businesses, especially retail stores, keep large amounts of money with them merely as floating cash.
If you let someone live with you without getting written permission from the rental provider or property manager, you may be “breaching” your lease agreement.
Paying wages in cash is legal and may be more convenient. Some businesses deliberately use cash transactions (for example, pay their employees 'cash-in-hand') to avoid meeting their tax and employee responsibilities.
Any request you make to pay less rent should be made in writing and should include as much information about the situation as possible. Make sure you have data or evidence to back up your claims regarding why you should pay less rent.
For a fixed-term agreement
The landlord can give you 30 days notice to end your fixed term agreement. The last day they can give you 30 days notice is on the last day of your fixed-term agreement. You can leave at any time before the date on the notice, but you will have to pay the rent until the end of the fixed term.
In this Australian state, landlords need to provide a notice to vacate for either 14 or 28 days before the stated eviction date. The notice shows the date on which the document was given to the tenant, address, name of both parties, reasons for evacuation notice, and the date from which the notice period is effective.
The costs you could be asked to pay include: Compensation equal to the cost of the rent from the time you move out and a new renter moves in or until the end of the fixed term, whichever happens first. Reletting fee – usually equal to one or two weeks' rent.
Under the new laws, that amount has changed. Rental providers can only ask for rent to be paid more than one month in advance if the weekly rent exceeds $900. Your rental income usually affects your pension if you are earning from leasing real estate you own. There are some exceptions, like if you are in a care or aged facility. There are also exceptions when it comes to medical conditions like intellectual disabilities.
You can request a warrant for possession if a tenant or resident has not left the premises, and NCAT has made orders for termination and possession. A warrant for possession authorises a Sheriff's Officer to enter the premises and evict the tenant or resident.

The increase must be up to market and justifiable – however, there is no cap on the increase. If the tenant's lease is fixed – the landlord cannot increase the rent.
